Lack of effective risk control measures and safe systems of work are likely to result in increased costs resulting from a higher number of incidents and accidents (plus that of possible litigation by injured parties). As well as the direct financial cost there are other negative effects, such as low employee morale and reduced productivity. These extra costs can be as much as 90% of those incurred as a result of a reportable accident and are not covered by insurance.

Most health and safety measures needed to comply with legislation are relatively low cost compared to the potential costs that might result from a successful court action, and regular inspection avoids the danger of having an improvement or prohibition notice served by an enforcing authority. In 2010/11 551 offences were prosecuted by the Health and Safety Executive and the Office of Rail Regulation, and 129 offences were prosecuted by local authorities.
